The key is acting quickly. Once a bailiff date has been issued, time becomes extremely limited. Understanding your position and taking immediate steps can sometimes pause proceedings and give you the opportunity to present your case to the court.

Eviction typically follows a structured legal process:

  • 1- Missed payments or breach of agreement
  • 2- Court proceedings and possession order
  • 3- Warrant of eviction issued
  • 4- Bailiff appointment scheduled

At the enforcement stage, the court has already granted possession to the lender or landlord. However, this does not always mean the situation cannot be reviewed.

Can Eviction Be Stopped?

In certain cases, YES!

If your circumstances have changed, if a repayment proposal is available or if you were not able to present your case fully at the original hearing, you may be able to apply to the court to suspend the eviction.

This is commonly done through an N244 application, which asks a judge to review the case before enforcement takes place. If accepted, the court may list an emergency hearing prior to the eviction date. Outcomes depend on individual circumstances, but presenting a clear and realistic proposal significantly improves the strength of the request.
